THE AGREEMENT

Terms of Service

The terms for visiting Millions, creating on the canvas, purchasing pixels, and participating in the finished painting.

01 Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of Millions Gallery, including the shared 1,000 × 1,000 canvas, pixel editor, checkout, creator profiles, messages, member gallery, leaderboard, reports, emails, and related features (collectively, the "Service"). "Millions," "we," "us," and "our" refer to the operator of Millions Gallery.

By accessing the Service, creating an account, submitting content, or completing a purchase, you agree to these Terms, our Community Rules, and our Privacy Policy. If you do not agree, do not use the Service or purchase pixels.

02 Eligibility and accounts

  • You must be at least 18 years old and legally able to enter a binding agreement.
  • If you use Millions for an organization, you confirm that you are authorized to bind it to these Terms.
  • You must provide accurate account information, protect your credentials, and promptly tell us if you believe your account has been compromised.
  • Usernames are unique, may not impersonate others, and may be changed, reclaimed, or removed when required to protect the Service or third-party rights.

You may purchase pixels without creating an account first. When checkout is completed, we may use the checkout email to connect the purchase to an existing account or send an invitation to create one. You are responsible for using an email address you control.

03 The canvas and pixel ownership

Millions is a public collaborative artwork made from 1,000,000 pixel coordinates. Each available pixel is priced at US $1, plus the Stripe processing fee shown before payment and any tax that may apply. Pricing or fees may change for future purchases, but the total displayed at checkout controls that transaction.

A completed payment assigns your account the Service's record of ownership for the purchased pixel coordinates and the right to display permitted content in those pixels, subject to these Terms. It does not transfer intellectual-property rights in the Millions software, site design, canvas as a collective work, or another creator's content. Pixel ownership is a Service record; it is not cryptocurrency, a token, a security, or ownership of physical property.

We do not promise that a digital or physical exhibition, sale, publication, or other event will occur, or that owning pixels will have financial or resale value.

04 Selections, reservations, and checkout

Selecting or previewing pixels does not claim them. Starting checkout may temporarily reserve selected pixels so two customers cannot buy the same coordinates. Reservations expire or may be released when checkout is canceled, abandoned, or fails.

Because the board is live, pixels can become unavailable before your reservation is created. A purchase is complete only after Stripe confirms payment and Millions records the purchase. If payment succeeds but fulfillment is delayed, we may retry fulfillment, contact you, provide equivalent remediation, or refund the affected transaction where appropriate.

05 Payments, cancellations, and refunds

Stripe processes checkout. Stripe's terms and privacy practices apply to its services. We do not receive or store your complete payment-card number. You authorize the displayed pixel price, processing fee, and applicable taxes when you submit payment.

Completed pixel purchases are final and non-refundable because the purchased coordinates are assigned and published as part of the shared artwork when payment is fulfilled. Closing checkout before payment does not complete a purchase. Nothing in this section limits a refund or consumer right that cannot legally be waived.

Do not initiate an improper chargeback for a valid purchase. If a payment is reversed, fraudulent, or disputed without a valid legal basis, we may restrict the associated content, pixels, and account while the matter is reviewed.

06 Your content

"Your Content" includes pixel colors and artwork, uploaded images, names, usernames, profile photos, messages, social links, website links, reports, and other material you submit. You retain any rights you already have in Your Content.

You grant Millions a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, crop, convert to pixel art, format, display, distribute, and otherwise use Your Content as reasonably necessary to operate, secure, moderate, improve, archive, and promote the Service and the collective Millions artwork. This license lasts while the content is used by the Service and, for purchased pixel artwork and reasonable archival or promotional copies, may continue after account closure.

You represent that you own Your Content or have all permissions needed to submit it; that our permitted use will not violate another person's rights; and that Your Content follows the Community Rules and applicable law. You are responsible for Your Content.

07 Public profiles, messages, and links

Pixel artwork and creator profile information are designed to be public. Visitors may see and share your name, username, profile photo, messages, social links, member number, pixel totals, rank, purchase date, purchase size, and the coordinates associated with your work. Search engines or third parties may index or preserve public content.

Each purchase may have one message of up to 140 characters. You may edit a submitted message for one hour; after that, it locks. This window is a product feature, not a guarantee that every edit or deletion request can be honored. We may still correct, hide, or remove content for moderation, safety, legal, or technical reasons.

Links lead to third-party services that Millions does not control or endorse. You visit them at your own risk and are responsible for keeping your own links accurate and safe.

08 Prohibited use

You may not misuse the Service. Prohibited activity includes violating the Community Rules; breaking applicable law; infringing intellectual property or privacy rights; attempting fraud or payment abuse; uploading malware; probing or bypassing security, rate limits, reservations, or access controls; interfering with other users; scraping beyond ordinary browsing; using unauthorized automation; reverse engineering except where mandatory law permits it; or using the Service to build a competing database or canvas.

09 Moderation, reports, and removal

We may investigate reports and may refuse, restrict, hide, preserve, or remove content, links, profiles, or account access when we reasonably believe there is a violation of these Terms, the Community Rules, third-party rights, or law, or a risk to users, the artwork, payments, or the Service. We may act with or without advance notice where appropriate.

Removal or restriction for a violation does not create a refund right. We are not required to monitor all content and cannot guarantee that every violation will be identified. You may use the in-product report tool for community violations. For intellectual-property notices, contact us with your identity, the content and location at issue, the basis for your claim, and confirmation that the notice is accurate and authorized.

10 Millions intellectual property

The Service, including its software, layout, visual identity, tools, copy, and non-user content, belongs to Millions or its licensors and is protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. "Millions," "Millions Gallery," and associated branding may not be used in a way that suggests endorsement or affiliation without permission.

11 Third-party services

The Service depends on providers such as Stripe for payments, Supabase for account and data infrastructure, Resend for transactional email, and hosting or security providers. Their services may have separate terms. Their outages, restrictions, or decisions can affect Millions and may be outside our control.

12 Service changes and availability

We may update, suspend, limit, or discontinue features to maintain security, comply with law, or improve the Service. We aim to preserve completed pixel ownership records and artwork, but we do not promise perpetual storage, uninterrupted availability, error-free operation, a particular audience, traffic, rank, or outcome.

We may update these Terms. The date at the top identifies the current version. Material changes will be posted through the Service or communicated when required. The Terms in effect when a purchase was completed generally govern that purchase, except where a later change is required by law or needed to address security or abuse.

13 Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement. We do not warrant that the Service will always be secure, available, accurate, or free of errors, or that user content and linked destinations are truthful, lawful, or safe.

14 Limitation of liability

Nothing in these Terms excludes liability that cannot be excluded by law. To the fullest extent permitted by law, Millions and people working on the Service will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service.

To the fullest extent permitted by law, our aggregate liability for a claim connected to a pixel purchase will not exceed the amount you paid Millions for the purchase giving rise to the claim. These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose.

15 Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Millions and people working on the Service from third-party claims, damages, losses, and reasonable legal costs arising from Your Content, your linked destinations, your misuse of the Service, your breach of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim was caused by our own unlawful conduct.

16 General terms

Applicable law governs these Terms, while any mandatory consumer protections available to you remain in effect. If one provision is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them with a transfer of the Service. These Terms, the Community Rules, the Privacy Policy, and the checkout details form the entire agreement about the Service.
